By accessing or using TakedownDesk ("Platform", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
1.1 Nature of Service & Not Legal Advice
TakedownDesk is a document automation, logistics, and routing software utility. We are not a law firm, and we do not provide legal advice, representation, or legal strategy. Your use of this platform does not create an attorney-client relationship. If you require legal advice regarding copyright infringement, you must consult an attorney.
1.2 User Obligations and Penalty of Perjury
To use our automated dispatch engine, you must explicitly declare that you are the copyright owner or an authorized agent thereof. By submitting a takedown request, you swear under penalty of perjury that:
- The information provided in the notification is strictly accurate.
- You have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
Submitting false or malicious takedown requests may expose you to civil liabilities, damages, and criminal prosecution. TakedownDesk reserves the right to cooperate fully with law enforcement and web hosts regarding fraudulent submissions.
1.3 Fees, Dispatch, and Refunds
Our service charges a flat fee for the generation and routing of your legal notice. Because our system dispatches the notice instantly upon successful payment, all sales are final and non-refundable.
We guarantee the successful drafting and routing of the notice to the relevant hosting provider's published abuse or legal contact. However, we do not and cannot guarantee that the hosting provider will comply, respond, or remove the infringing material.
1.4 Governing Law
These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising from the use of this utility shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
2. Privacy Policy
TakedownDesk operates on a zero-friction, minimal-retention philosophy. We only collect the data absolutely necessary to execute your requested legal document.
2.1 Data We Collect
- Submitted Information: Your legal name, email address, and the URLs you provide via our form.
- Payment Information: Processed securely via our third-party gateway (Razorpay). TakedownDesk does not collect, store, or have access to your credit card numbers or banking credentials.
- Technical Data: Basic server logs (IP address, browser type) for security and anti-fraud monitoring.
2.2 Mandatory Data Sharing (Crucial)
By using this service, you understand and agree that your legal name, email address, and the submitted URLs will be embedded into the legal DMCA/Copyright notice and sent directly to the hosting provider. This is a legal requirement for a valid takedown notice. The hosting provider may, by law or policy, forward a copy of your notice (including your name and email) to the alleged infringer.
2.3 Data Retention
We do not require account creation. We retain records of generated notices and transaction logs solely for accounting, tax, and legal compliance purposes (e.g., proving that a notice was dispatched if legally queried). We do not sell, rent, or trade your data to marketers.
